Lexus Financial Services may pay the Lexus Centre a commission for introducing you to them. Commission may be calculated based on either a fixed amount relating to the vehicle you are financing, a percentage of the amount you borrow, or a combination of both. Lexus Financial Services may also make other types of payment to the Lexus Centres for introducing you to them. Any such amounts will not affect the amounts you pay to Lexus Financial Services under your finance agreement. The Lexus centre is acting as credit broker and not a lender.
1) About our Fuel Card Promotion
a) Under this Fuel Card promotion, eligible customers are entitled to purchase vehicle fuel using a pre-paid payment card up to a value of £250.00
b) This Fuel Card promotion closes on 31st October 2022.
c) This Fuel Card promotion is made available and offered to you by Toyota Financial Services (UK) PLC trading as Lexus Financial Services (referred to as “we” “our” “us”) under these terms and the terms of our relevant partners.
d) The Fuel Card is provided, served and fulfilled by our contracted service provider partner; Motivates Inc. Ltd (“Motivates”).
e) Your registration and use of the Fuel Card will be under a separate agreement between you and Motivates under Motivates Terms and Conditions and Motivates Privacy Notice and Privacy Policy with regard to the use by Motivates of your personal data. f) Motivates works with and has contracted the business and service provider; Their Perfect Gift to fulfil, validate and activate the Fuel Card. These services are provided under Their Perfect Gifts’ own terms which will apply to you together with its Privacy Notice and Privacy Policy with regard to the use by Their Perfect Gift of your personal data.
2) Eligibility, validation and duration
a) To be eligible to receive a Fuel Card, you must be a customer of ours that has financed a used vehicle on used retail sales proposed by us between 1st August 2022 and 3rd October 2022 and registered the vehicle and entered into our finance agreement by 30th September 2023.
b) The amount that you finance after the payment of any deposit and any other initial costs must be a balance of at least £5,000.00 (five thousand Pounds Sterling).
c) You must claim your Fuel Card within 45 days of making your first qualifying payment under your finance agreement with us.
d) We will create a sign-up report after our customers have completed their first monthly payment under their finance agreement with us. This report will be provided to Motivates. If you are eligible to receive a Fuel Card, an email will then be sent to you with information and instructions about the registration and activation of your Fuel Card.
e) You will receive registration and activation details of your Fuel Card including a website Link once your first monthly payment has been made under your finance agreement with us.
f) Any lost or damaged Fuel Cards can be replaced with charges of £5 per card and £2 per Pin Number.
g) Once you have registered, if you haven’t received your Fuel Card, please email our team at ToyotaFuelCards@motivates.co.uk
h) All Fuel Cards must be validated and activated before use and are valid for 12 months from activation.
i) The duration of validity and use of the Fuel Card cannot be extended once expired and no payment of any unspent sums will be made.
3) General Terms
a) The fuel that you purchase using your Fuel Card will be provided and supplied by your selected fuel retailer in the United Kingdom at the selected retailers’ fuel station site premises.
b) In order to prevent fraud and to comply with anti money laundering regulations we or Motivates may ask for further proof of identification before fulfilling your Fuel Card.
c) Motivates may cancel your Fuel Card if it has a reasonable suspicion that the terms of the promotion or the terms of the Fuel Card are being breached or abused.
d) We may cancel your Fuel Card if your finance agreement with us ends for any reason.
e) Fuel Cards are accepted at all fuel retailers within the United Kingdom that accept Mastercard Chip and Pin payment.
f) You must ensure that you have sufficient pre-paid funds available on your Fuel Card to pay for each fuel purchase.
g) The Fuel Card can be used for this pre-paid Fuel Card promotion only. It is not linked to a bank deposit account and is not a cheque guarantee card, banking card, charge card or credit card, nor may your Fuel Card be used as evidence of identity.
h) The (physical) Fuel Card can be used for the purchase of fuel only. No funds can be withdrawn from ATMs. The Fuel Card may not be used for pre-authorised regular payments (such as subscriptions), or for any illegal purposes.
i) You may check the balance and available funds on your Fuel Card by visiting www.cardportal.com or via the TheirPerfectGift smartphone app, where your card is “added” to the App.
j) Your Fuel Card cannot and must not be resold.
k) The Fuel Card is available to our eligible customers and is not transferrable to any other person.
l) We may withdraw this Fuel Card promotion at any time and we shall not be responsible for any failure or disruption to the provision of the fuel or Fuel Card for reasons or events that are beyond our reasonable control. We do not accept responsibility or liability for fluctuation in fuel prices, disruption to the availability or supply of fuel or for mis-fuelling.
m) No alternative gifts will be offered, there is no cash alternative and the value of your Fuel Card cannot be applied to your finance agreement.
n) Your Fuel Card will be provided and fulfilled by Motivates. We will not be responsible for any failure, delay or loss in the provision of the Fuel Card for any reason.
o) We may amend these terms at any time.
p) These terms are between you and us. No other person shall have any rights to enforce them. We shall not be responsible or liable for any of the terms or obligations under any agreement that you may have with Motivates or Their Perfect Gift.
q) The laws of England and Wales shall apply.
4) Our responsibility for loss or damage suffered by you
a) In respect of your use of the Fuel Card and the supply and use of the fuel, your rights as a consumer will apply and will be described in Motivates’ terms of supply and the relevant fuel retailers’ terms of supply respectively.
b) We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors or for fraud or fraudulent misrepresentation.
c) We are responsible to you for foreseeable loss and damage caused by us. If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or our failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time you accept these terms, both we and you knew it might happen.
d) We are not liable for business losses. The Fuel Card is for domestic and private use. If you use the Fuel Card for any commercial, business or resale purpose we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
5) Your privacy
a) We will only use any personal data that you give to us to provide, administer and enforce this Fuel Card promotion. We will only use and process your personal data when the law allows us to.
b) We will use and process your personal data on the basis that we need to take steps to enter into or to perform a contract for the offering, administration and supply of the Fuel Card under this Fuel Card promotion.
c) Further information about how we use your personal data is set out in our Privacy Policy which is available on our website.
d) We will share your personal data being your name, email address, agreement number, address and car registration with Motivates so that Motivates may provide, administer and fulfil your Fuel Card under this Fuel Card promotion.
